  1. Only advertising orders that have been confirmed by the publisher shall be deemed to have been accepted.
  2. Advertising orders can be cancelled until the respective closing date only.
  3. It cannot be guaranteed that advertisements will be published in certain numbers or editions or in specified positions.
  4. Proof sheets shall be supplied on express request only. The client shall be responisible for the correctness of the proof after return. If the proof is not returned within due time, it will be regarded as having been accepted for printing.
  5. The publishers guarantee a faultless printing quality of the advertisements. Unsuitable or damaged printing materials will be returned to the client without delay.
  6. The client shall be entitled to reduce a payment or to claim damages if the advertisement is illegible in whole or in part or has been printed incorrectly or incompletely unless the purpose of the insertion is impaired by the defect to a minor extent only. The complaint about defects must be submitted to the publishers in writing within four weeks after preparation of the invoice and must include good reasons.
  7. In case any defects in the printing materials cannot be immediately recognized, and if such defects are only detected when printing the materials, the advertiser shall not be entitled to claims whatsoever for imperfect printing results.
  8. In terms of finance, liability for direct or indirect damages resulting from the violation of a contract shall be limited to the individual net price of the advertisement unless the damage has been caused by intentional or grossly negligent violation of the contract.
  9. The publishers shall furnish specimen copies of the respective page, or complete editions for half-page size or larger advertisements, immediately after publication of the advertisement.
  10. The discounts discribed in the advertising price list shall only be granted to the advertisers and only for the advertisements published within one year. Unless otherwise agreed, this term will begin upon the publication of the first advertisement.
  11. If the order is extended the client shall be entitled to retroactive discounts provided that the underlying order had already been liable to discount; the right to discounts shall terminate unless it is asserted within one month after expiry of the advertising year, at the latest. If an order does not reach the envisaged number of advertisements, the discount granted in excess shall be invoiced later.
  12. The costs of substantial modifications of originally agreed designs and of the delivery of ordered printing plates, films or drawings shall be borne by the client.
  13. In the case of box number advertisements, the publishers shall be responsible for the storage and expedient transmission of the incoming offers. Incoming registered mail shall be transferred as registered mail only if the postage is enclosed. No guarantee can be assumed for the storage and timely transmission of the offers.
  14. The publishers reserve the right to charge unexpected postage fees and other additonal costs to the client. The postage fees are payable in full without any discounts or agency commissions.
  15. In the case of modifications for the advertising price list, the new conditions shall also apply to orders in process.
  16. Decreases in the circulation shall affect the contractual relationship only if a certain circulation had been guaranteed and if this circulation drops by more than 20%.
  17. Text advertisements which are designed so that they cannot be recognized as such shall be marked as advertisements.
  18. For color advertisements: Lithos with authentic preprint on original paper. (Paper samples are available on request.)
  19. If the journal cannot be published for reasons of force majeure, strike or similar, the publishers shall not be responsible to the client in any way whatsoever.
  20. Should one clause be invalid, the validity of the remaining clauses shall not be affected.
